The Ministry of Health and Prevention (MOHAP) of the UAE issued new controls and procedures for abortion in order to "preserve the pregnant woman's life, ensure her safety, and enhance oversight of healthcare facilities."

Who will make decisions on abortion requests?

A dedicated committee will be formed within each health authority by a decision of MOHAP or the head of the emirate's health authority. It will consist of:

  1. An obstetrics and gynecology specialist.
  2. A psychiatry specialist.
  3. A representative of the Public Prosecution.

The committee will consult a third party with the appropriate specialty and expertise when needed.

When is abortion permissible?

There are three cases wherein abortion in the UAE is permissible, according to MOHAP. Each of them should be supported by a medical report issued by a specialized medical committee.

  1. If continuing the pregnancy endangers the pregnant woman's life, in the absence of any alternative way to save her life.
  2. If the fetus' deformation is severe, proven, and will affect the newborn's health and life.
  3. Several other cases, provided that the gestational period at the time of the abortion procedure does not exceed 120 days.

Who will perform an abortion and where?

Abortions can only be performed in a healthcare facility licensed by the competent health authority to perform abortions. It should be carried out by a specialist obstetrician-gynecologist licensed to practice within the country. The abortion should be free of any medical complications that may put the pregnant woman's life at high risk.

Healthcare authorities will soon come up with policies that define the responsibilities and obligations of healthcare facilities, which will be regularly monitored, and medical staff in charge of the procedure. The rights and responsibilities of the pregnant woman, and health care requirements before and after are to be detailed as well.

As per new controls, healthcare facilities are obligated to protect the privacy and confidentiality of the women undergoing abortions.
