Mahmood Khan Achakzai, leader of the opposition in Pakistan's National Assembly, appeared in the Balochistan High Court on Wednesday to seek bail over a case filed after a public rally in Chaman on May 29. His party has dismissed the FIR as politically motivated and an attempt to derail ongoing talks between the opposition and the government.

Why was Achakzai booked after the Chaman rally?

A local resident, Abdul Wali Khan, filed a complaint at Chaman's City Police Station alleging that Achakzai made inflammatory remarks at the rally. The FIR accuses him of promoting enmity against state institutions, inciting public disaffection, blocking a public road and violating loudspeaker rules. A video recording of the speech was submitted to police as evidence.

What did Achakzai say in the rally speech?

Around 650 to 700 people gathered at the Government High School Ground in Chaman when Achakzai addressed the rally. According to the FIR, he criticized the provincial government's failure to protect people and described the current rulers as "fake" figures imposed through Form-47. He also allegedly proposed creating an alternative force by recruiting people from different tribes, and encouraged Pashtuns in Chaman to obtain Afghan national identity cards.

Achakzai's party has strongly rejected the allegations. Akhtarzada Hussain, spokesperson for the Pakistan Constitution Protection Movement, told Nukta that the FIR was designed to sabotage negotiations between the opposition and the government. He also said it was intended to worsen the security environment in Balochistan's Pashtun areas. Addressing lawyers inside the court, Achakzai described the case as fascist and engineered by the state.

What charges does Achakzai face over the Chaman rally?

The charges relate to the promotion of enmity, public mischief, wrongful restraint, rioting and alleged attempts to undermine state institutions. Authorities also allege violations of provincial rules governing public address systems. No immediate ruling on the bail application was announced.

What did the Balochistan government say about the Achakzai FIR?

Balochistan government spokesperson Shahid Rind told Nukta that the FIR was not filed at the government's direction. He described it as the act of an individual citizen exercising his legal rights. Rind said the matter was now before the court and the government had no involvement in the case.

How has Afghanistan responded to Achakzai's remarks?

The controversy drew criticism from across the border. Nasir Andesha, Afghanistan's former Deputy Foreign Minister and current Permanent Representative to the United Nations, criticized Achakzai in a post on X, referring to him as a two-faced Khan. Andesha took issue with the call for Pashtuns to obtain Afghan identity cards, saying Afghanistan is home to multiple ethnicities and Afghan Pashtuns are one of several.

Andesha called on Pashtun political figures to stop using Afghanistan for domestic political purposes and focus instead on constitutional challenges within Pakistan. He said Afghanistan needed moral support to free itself from Taliban rule, and expressed willingness to offer support in return.
