Pakistan's suspended cybercrime chief has petitioned the Islamabad High Court to halt a formal corruption inquiry against him. Waqar-ud-Din Syed, founding director general of the National Cyber Crime Investigation Agency (NCCIA), argues that authorities denied him access to evidence and violated due process after issuing a charge sheet on June 3, 2026.

What corruption charges is the former NCCIA chief facing?

The Establishment Division accuses Syed of bribery, extortion and abuse of authority during his tenure from April to October 2025. Specifically, the charge sheet alleges he received illegal payments from officers in exchange for postings, took bribes to protect illegal call centers and placed loyalists in operational roles for financial gain. His declared net worth also rose from Rs2.460 million in 2002 to Rs20.992 million in 2018, which authorities say requires explanation.

What did Waqar-ud-Din Syed do as NCCIA chief?

Syed oversaw some of Pakistan's most prominent cybercrime cases during his six-month tenure. The agency pursued online personality Saadur Rehman, known as Ducky Bhai, over alleged illegal online gambling, and initiated cases against several journalists. NCCIA also raided a call center linked to Pakistan Muslim League-N leader Malik Tehseen Awan in Faisalabad, arresting 77 people including foreign nationals. The agency additionally prosecuted Imaan Mazari and Hadi Ali Chattha, who are currently serving 17-year prison sentences, and issued notices to more than a dozen social media influencers.

Why did the government launch an inquiry against the suspended NCCIA chief?

Prime Minister Shehbaz Sharif authorised the inquiry following eyewitness statements and video-recorded confessions from three Lahore-based NCCIA officers. Additional Director Ch. Sarfraz, Deputy Director Zafar Ahmed and Deputy Director (Operations) Muhammad Usman each alleged that Syed encouraged extortion through subordinate officers and NCCIA circle offices. The Establishment Division's charge sheet, signed by Secretary Barrister Nabeel A. Awan, frames the allegations as misconduct, corruption and conduct unbecoming of a civil servant under the Civil Servants (Efficiency and Discipline) Rules, 2020.

What due process violations does Syed allege in his petition?

Syed received the charge sheet on June 5 and was entitled to 14 days to submit a written defence. He argues that despite repeated requests, authorities failed to provide the documentary record and evidence underlying the allegations. The inquiry officer proceeded to summon witnesses before that response period expired, including a fresh summons on June 16, even though Syed's application to replace the inquiry officer under Rule 9(4) remained undecided.

What specific procedural objections does Syed raise?

Syed challenged witness notices issued on NCCIA letterhead rather than directly by the inquiry officer, describing this as a jurisdictional defect. He further argued that holding proceedings at NCCIA premises creates institutional pressure on him and potential witnesses, undermining the fairness of the process. Recording witness testimony before deciding his pending applications, he contends, deprived him of an effective legal remedy and reflected undue haste.

What relief has the suspended NCCIA chief sought from the court?

Syed has asked the court to declare the continuation of proceedings unlawful and direct the Establishment Division to decide his pending applications within a fixed timeframe. He has also sought suspension of witness examinations until those matters are resolved, the appointment of an independent inquiry officer and the use of a neutral venue. His petition cites his constitutional right to a fair trial under Article 10A, along with protections under Articles 4 and 25 of the Constitution. Syed states he has no intention of delaying the inquiry and remains willing to cooperate, provided it is conducted strictly in accordance with law and due process.
