Dubai landlords cannot disconnect air conditioning, electricity or water during a rental dispute, Gulf News reported. The ban applies even when a tenant has unpaid rent. Article 34 of Dubai Law No. 26 of 2007 protects tenants in such cases.

Can a landlord in Dubai cut AC, water or electricity?

No. Under Article 34, a Dubai landlord cannot disconnect services to a rented property or disturb the tenant’s use of it. This covers disputes over unpaid rent, rent increases, tenancy renewals and eviction. Landlords must use the legal process instead of cutting services.

What does Article 34 say about service disconnections?

Article 34 regulates the relationship between landlords and tenants. It prohibits landlords from interfering with a tenant’s use of the property. A landlord cannot cut services to pressure a tenant into paying or leaving.

The law states: “The Landlord may not disconnect services from the Real Property or disturb the Tenant in his use of the Real Property in any manner.”

What can a landlord do if a tenant has unpaid rent?

A landlord cannot use disconnections to force a tenant out, even when rent is overdue. Landlords who want to recover unpaid rent or seek eviction must follow the procedures set out in Dubai’s tenancy legislation.

The Rental Disputes Centre (RDC) adjudicates such cases within its jurisdiction. It operates under the Dubai Land Department.

What should tenants do if services are cut?

Article 34 gives tenants two options. They can approach the police station responsible for the area where the property is located. There, they can seek assistance or file a report about the violation.

Tenants can also go to the RDC to seek legal remedies. These include compensation for losses caused by the landlord’s actions.

Can tenants claim compensation for disconnected services?

Yes, but compensation is not automatic. Article 34 allows tenants to claim damages for losses caused by a landlord’s unlawful actions. Claims must be backed by official reports and evidence of the violation and the resulting losses.

Tenants should keep all relevant records. These include written messages with the landlord or property management company, records of service interruptions, maintenance complaints and any official reports. These documents may help if the dispute is referred to the authorities.
