Can haq mehar be legally enforced if it's not written in the nikkah nama?

A recent Lahore High Court ruling says yes.

The case involved a woman from Chiniot who sought to enforce a separate written agreement that promised her a five-marla house and Rs300,000 as haq mehar in the event of an unjustified divorce.

After winning in family court, her former husband challenged the decision all the way to the Lahore High Court.

Justice Sajid Mahmood Sethi upheld the lower court's ruling, clarifying that haq mehar is not limited to what is recorded in the nikkah nama.

According to the court, it can be agreed upon before, during, or after marriage through a valid agreement.
The 11-page judgment is being viewed as an important precedent for women's legal rights in Pakistan.
