Pakistan court cancels bail of ex-spy chief Faiz Hameed’s brother in fraud case

A Pakistan court canceled on Monday the bail of Najaf Hameed, the brother of former Director General Inter-Services Intelligence Lt. Gen. (retd) Faiz Hameed, in a fraud case registered by the Federal Investigation Agency.

Islamabad Special Court’s (Central) Special Judge Central FIA Shah Rukh Arjumand announced the reserved verdict on an application filed by the FIA seeking cancellation of Hameed’s bail.

Najaf Hameed was not taken into custody as he was not present in court when the order was announced. Court records show Hameed had earlier been granted bail based on a settlement between the parties.

The FIA later approached the court, arguing that the compromise was not legally sustainable and that the accused had allegedly violated its terms.

After hearing arguments from both sides, the court accepted the FIA’s plea and revoked the bail order.

What’s the case?

The case involves allegations of fraud and financial deception that remain under investigation by the FIA.

The agency said sufficient evidence exists to proceed against the accused and that custodial investigation is necessary.

Following the cancellation of bail, the FIA is expected to initiate further legal action to secure Hameed’s arrest.

Faiz Hameed's conviction

Last month, Faiz Hameed was convicted by a Field General Court Martial and sentenced to 14 years of rigorous imprisonment.

The verdict concluded a 15-month trial of one of Pakistan’s most high-profile former intelligence officials.

Inter-Services Public Relations said the court found Hameed guilty on four charges, including involvement in political activities, violations of the Official Secrets Act that harmed state security, misuse of authority and government resources, and causing wrongful loss to individuals.

ISPR said the court martial proceedings began on Aug. 12, 2024, under the Pakistan Army Act.

The military’s media wing described the trial as involving “lengthy and laborious” legal processes and said the court convicted Hameed on all counts.

The army said the process complied with all legal requirements and that Hameed was given full rights, including the choice of his defense team.

ISPR said Hameed retains the right to appeal before the appropriate forum under military law.

The military added that Hameed’s alleged role in fomenting political agitation and instability with political elements is being addressed separately.
